Obtaining an Absolute Divorce

In order to obtain an absolute divorce in Maryland, you must prove grounds for this specific type of divorce. There are both "no fault" and "fault" grounds. New law, effective October 1, 2011, provides for the "no fault" grounds of one-year separation. It is no longer a requirement in Maryland that the separation be by a mutual and voluntary agreement to enable the filing of an absolute divorce complaint after the expiration of a 12-month separation. There are also a number of "fault" grounds, including adultery, desertion, cruelty of treatment and excessively vicious conduct.
